How do I provide RockStar with the documents for service?

You will attach the documents via PDF during the checkout process. This is the last step of the process.

If you want to physically drop off the documents to our office. Please give us a call beforehand so we can coordinate with you.

If you have out of state documents that require the original to be served, you can mail us the service. If you do need to mail the service, please contact us by using the “contact us” section on the website to let us know you will be mailing documents, so we can keep an eye out for them. You can also order your service through the website and give us all the details for the service and just let us know in the “Additional Info” section that you will be mailing the documents.

What information does RockStar need for a service?

We will need the name and address for service, the documents for service, and any additional information that will help the server, such as: pictures or a physical description of the person being served, vehicles, information about the location, best times for service, whether they are aware of the service or will avoid service, other individuals living in the same residence, etc.

You will provide all of this information during the checkout process through the website.

Can I provide RockStar with a picture of the person being served, their vehicles or pictures of the location?

Yes. We highly encourage you to provide us with everything you can that will help the server complete your service. You can attach pictures in the same attachment section where you attach the documents for service. This is the last step in the checkout process. 

If you cannot provide any pictures, you can give us physical descriptions and instructions in the “Additional Info” section during the checkout process.

How do I pay? Do I have to pay upfront?

We do require payment prior to the service. When ordering on our website, after adding your service(s) and reviewing your cart, the next step in the process will be to make the payment. After making the payment you will provide us with the details and documents for service. 

If you are mailing or dropping the documents to our office, you can leave a check or cash in the envelope with the documents. If we notice that we have not received payment, we will contact you prior to the service to acquire the payment via credit/debit card.  

Does RockStar guarantee service? Do I get a refund if service is not completed?

We cannot guarantee that your documents will be served. We can only guarantee that we will try our best to get them served. There is no refund if services are not successful.  

If we cannot get your documents served, you can be provided with a declaration. The declaration will state the details of our service attempts, such as the dates, times and details of the attempts. This is then signed and dated by the process server and emailed to you and/or mailed to the court. 

How many attempts are made on a service?

With our Same Day, Next Day and Standard services, you get 3-5 attempts. Stakeout Services are a one time shot (hourly purchase). Service attempts are done on different days and usually at different times of the day or evening, unless specifically requested for certain times of the day or evening. The amount of attempts can vary depending on the service deadline date, bad address, etc.

What is a “proof of service” and do I as the client have to provide RockStar with this?

The proof of service is a legal document provided by RockStar for you. A proof of service states the details of the service including the case name, number, name of the court and the details of the service such as the date and time of service, name of person served and the documents served. It is then signed and dated by the process server. 

For self represented individuals, a copy of the proof of service is emailed to you and the original is mailed to the San Diego County courts for filing. Attorneys will be emailed their proofs of service for filing. If your documents were filed in a California court outside of San Diego County, we will email and/or mail you the proof of service for you to file with your court. For documents filed in an out of state court, we prepare a generic affidavit of service. You can provide us with your proof of service if your out of state court has a specific one they require. The proof of service or affidavit of service will then be emailed and/or mailed to you to file with your court.

Please note that certain out of state courts require the proof of service or affidavit of service to be notarized. If this is the case, please purchase the “Notarization” service through our website. If we are serving multiple defendants or cases, multiple notaries may need to be purchased.

Are there printing fees and how do I pay them?

Yes. We charge $.20 a page after 40 pages for printing. If your order has over 40 pages for service, we will then email you the total that you owe and the instructions of how to pay this on the website. The instructions to pay this will be to click on “Open Ended Amount” on the bottom left hand side to the “Order” page and enter the amount there. You can also calculate the total yourself and add the Open Ended Amount to your cart for checkout with your order.

What if I need something filed with the court and the court has a filing fee? What if I need to serve witness fees with my service?

If you need Rockstar to write the check for you, we can. The check advancement fee is 8% or $4 minimum. When you send us the job, you will indicate that the advancement of fees is needed. You can pay by adding this amount (plus the 8% or $4 minimum) in the “Open Ended Amount” section on the “Order” page and add it to your cart for checkout. If we see you have not added the payment for fee advancement, we will email you with the total owed and instruct you to pay on the website. You can also mail the documents and checks to us for service or filing.
